Legal Question in Family Law in Florida
May ex wife and i recently ended a 2 year custody fight. She had taken me to court to try to get the children to live with her full time, and me every other weekend. The judge ruled against it, leaving our schedule the same, I have them Monday to thursday, she has them thursday to monday. She has educational authority since their school is near her home and i live 30 minutes away. Her child support was lowered since she had become an RN and now she owes 14000.00 retro to me for overpayment, per the judge. She is now trying to take me back to court for her lawyer fees for the 2 year court battle that she started. What do i need to prepare for and what are her chances of winning this?
1 Answer from Attorneys
Considering she was unsuccessful in her quest to get majority custody of the children, I think you have a strong argument against paying her attorneys fees. The judge does give weight for attorney's fees depending on who was the successful party. If you've spent on attorney's fees, you need to itemize all your expenses as well and file an affidavit to that effect and the both of you can schedule a hearing for both attorneys' fees at the same time.
