Legal Question in Family Law in Florida

Me and my wife are separated and her parents have temporary custody of my 2 year old daughter. what would i have to do to get her back? The reason they have temporary custody in the first place is I was financially unstable and the wife is on drugs and also unstable. Yes, i agreed to it. Now I have my life on track and all thats missing is my daughter.

If there is a temporary custody order in place, you can file file a petition for modification and request that your child be returned back to you for your reasons stated.

Or if DCF issued the temporary custody order to your parents then you would have to file a Motion for Reunification with the Juvenile Court and comply with the terms of your case plan, if any.

How did the grandparents get custody of your child? If it was through a petition for relative custody you can petition the court to end this custody upon a finding it is in the child's best interest. If DCF gave them custody then you have to complete the case plan that was assigned to you. Either way you will have show the stability to care for your child. I hope this helps.
