Legal Question in Family Law in Florida
My wife and I have been separated for years and are preparing to have a very amicable divorce. We have already separated everything, and are taking each other's names off our own annuities. We sold our marital home years back. I am filing myself, and am doing well with the paperwork. Here is my dilemma: we co-own a timeshare in Vegas which is paid for, and we have one debt which we each make a payment toward each month. We would like to continue in this manner. I pay the maintenance fee for the timeshare, and I use it. Neither of us wants to/can afford to buy the other out, so we would like to co-own it until it sells. Can I add a section to the marital settlement agreement stating this (following the same format as the rest of the document)? Is there anything special I need to do?

Absolutely. One place you could put it is in the "Other" section. I would state it fairly close to the way you stated it above. For example, Husband and Wife own a timeshare in Las Vegas. Husband agrees to continue to pay the maintenance on the timeshare and the parties shall continue to co-own the timeshare until such time as the parties agree to sell it. Upon sale, any proceeds shall be split evenly between the parties.
