Legal Question in Family Law in Florida

My wife and I are seperated but not legally divorced yet. She has our children ages 3,6,and 8. She has recently refused any contact with me, and will not allow me to speak to my children. What legal recourse do I have to be able to see my children. She lives with her parents, and her mother has threatened to have me arrested if I come on their property uninvited.

File a petition for divorce, for custody, visitation and child support. What are you waiting for?

If the marriage is over, file for divorce. Custody and all other issues would be addressed in the divorce.

Unless you are an endangerment to the children, you can use this against her. The Courts do not look kindly upon parents that attempt to frustrate the other parent's relationship with children.

If you opt to proceed without the assistance of counsel, be aware that you will not be entitled to a do over if things go badly.

An internet inquiry is no substitution for an in-office consultation with an attorney.
