Legal Question in Family Law in Florida

Are Wife's Finances Considered in Husband's Child Support

Ex-wife is suing Ex-husband for Child Support Arrearage -approximately $30,000.00 - which he denies as alot of payments were given in cash to the ex-wife which she has not credited to him and schedule of payment of the arrears to be establihed. Ex-wife's attorney is requesting production of financial statements; tax returns, W-2s,etc. Ex-husband's 2nd wife is concerned that her income is going to be considered by the Court in determining how much the Ex-husband can pay towards the arrearage as they file a joint tax return. Can the Court take into account the 2nd Wife's income, finances and her contribution to the household with Ex-husband's, is there anything 2nd Wife can do not to have her finances considered by the Court?

Issue of arrearage has nothing to do with your income.
