Wifes rights in a separation
I have been married for 13 years and have a 17 yr old stepson who has been out of cntrol for 10 years now. Counseling, meds, legal interventions has not worked. In the past, he has threatened me several time, cut up my clothes and the other day, tried to assault me. My husband and I have been at odds over his ineffectiiveness in this situation, and he refuses to turn to the court to have the child removed. I was going to petition the court myself, but my husband has said we are done if I do. This marriage is broken beyond repair. I cannot afford to move out because I work off the books as a pet sitter and am not financially able to do so. I had to stop working outside the home years ago because of the problems with the son. My husband refuses to move out and wont support me doing so either. What are my rights here? In the case of a separation, can the court make him and his son move out? We own the house jointly. Can he made to help me out financially? I just cant live like this anymore. Please help. Thank you

You do have a right in the home. You can file for divorce, and also file for temporary support. A judge can and will make the decision on the home. You should contact a lawyer in your area, and talk to them about your options.
