Will it affect my case if I move out of the house and come back daily to homeschool and take care of the kids?

Married 18 years. I'm the wife who wants divorce. Husband doesn't. He wants me to try moving to nearby apt and coming home daily to do what I've been doing. He doesn't want to move out. I have not worked since kids. Kids are 12 and 9.

Why are you moving out. You can get a Temporary Needs Order and have him move out and pay for the mortgage. You are entitled to Alimony and any equity in the house if you wish to sell. You need to talk to an attorney. He is just trying to get you out so he can keep the house and the equity in it. Also if you leave, you would be abandoning in some sense since you are letting him have them live with him as majority time sharing. Meaning when all is said and done, you will get visitation based on the fourth judicial guidelines. Further you can still file for divorce, move into another bedroom and remain in the house until the court decides who gets the house. There are lots of factors to consider.
