Legal Question in Family Law in Florida
Ex will not allow children to visit
Upon my divorce I was awarded custody of our seven children. Shortly after, I was so overwhelmed due to my ex husband constantly undermining my authority that I ended up in a physical altercation with one of my daughters over chores. She cussed me and I slapped her. Of course she called her father who instructed her to call the police. DCF became involved and he got custody of 3 of the children and I got the other 4. The DCF case was closed in March of 2002 to any further DCF involvement. The last court order states that custody remain the same. What about visitation? Should the divorce decree be in effect? I haven't seen the children that live with him since June 2004. He has never allowed me phone contact, involved me in school activities, or hospital stays of the children. As long as my parental rights have not been terminated, don't I have the right to participate in these things? I have been told that the police can't enforce my right to visitation and I have to fight this in the courts. I don't have money for an attorney and I don't know where to start. When I call, he doesn't answer the phone and he never calls me back to make arrangements for the four who live with me to go to his house to visit. Please help!!!
