Will a judge allow me to move out of state with my child

I have been divorced for approximately 3 years and am now living with my fiance with whom I have a daughter and am expecting another child in 2 months. I have a son from my first marriage who sees his father a few times a week and we have shared custody. But my fiance and I have recently had to file bankrupcy for reasons related to his business and he is wanting to find a job out of state. Will I be able to move out of state with my son if my ex-husband decides to fight me on this? In my divorce it stated that I had to reside in the county that I am currently in for 2 years and that has already past. But it also states that neither parent can take the child out of state without the others permission. My fiance is in a profession where it is hard to find a good job in Florida and I don't know how we can get back on our feet if we stay here. Would a judge consider this or would they deny my request to move the child away from the father?

There is no set rule. The court will look to the best interests of the child. The fact you have not remarried will be considered.
