Legal Question in Family Law in Florida

Can a woman in the Navy Reserve get custody

My wife wants primary custody of our minor children. She is currently in the Navy reserve. She took our children and moved to another state without my consent 2 weeks ago. She won't take my calls or let me talk to my kids. I want to talk to my kids/see my kids/or get physical custody of my kids. Can she leave without my permission.

Once I find out my rights can she get physical custody while she is in the Navy Reserve?

Thank you

Re: Can a woman in the Navy Reserve get custody

Whether or not she may get custody depends upon a lot of things. The "best interests sof the child" is the standard. Being in the reserves alone should not render her unable to parent or co-parent. However, she certainly cannot leave the state without your permission -- this is abduction even if its your own children, when you leave the state with the intent to deny access to the other parent. Speak to local law enforcement or local counsel asap.
