Legal Question in Family Law in Florida

I have a seven year old daughter and at the time she was born I was married but not to her biological dad. He is now considered her legal father. Biological dad did not know about his daughter until a year ago, we now live together and he has established a relationship with her.Biological dad wants to have paternity established and become her legal father to be able to provide medical etc. Legal dad does not want to give up paying either. What can I do

The biological father has the right to have a relationship with his daughter. Therefore, there is nothing that can prevent him from having the Paternity Action commenced. After the test proves that he is the father, he will be able to have his name added to her birth certificate at your local Vital Statistics office.

Her biological dad can file a Paternity Action. This action will establish him as the legal father. The court will require a DNA test. Once the you have court order you can update your daughter's birth certificate accordingly. You can find all the forms for this at flcourts.org.
