Legal Question in Family Law in Florida

I have a two year old and his father went to prison when i was six months pregnant and got out two weeks before his second birthday. he is on probation for two years. He was charged with aggrivated assault with a deadly weapon. he has a long history with criminal activity. i was just wondering if i take him to court can i get soul coustody. i also do not want to completely kick him out of the picture just want to make sure that i can make sure my son is always safe and not in danger of him or him having a chance to take him away. Also does a make a difference if he is on child support. by being on child support does it give him more rights over my son?

If you were NOT married to this guy, he has no rights and you already have SOLE CUSTODY!

Even if he pays child support, unless he files a petition with the court for visitation, until he gets a court order allowing him visitation, he has no rights.
