Legal Question in Family Law in Florida

I have had a one year old living with us for 6 months. He is a non relative.

Dad is incarcerated and mom has been in and out of jail and rehab.

Mother has no means to care for him.

Do I have any legal right to petition for custody?

If not related to the child then you have to file a petition for guardianship in Probate Court. Use a lawyer.
