Legal Question in Family Law in Florida

In the last year, my sons mother who is listed as the custodial parent has been in rehab twice, arrested 4 times for drug possession, shoplifting, and driving under the influence, some of these with my son present. Currently she is admittedly on drugs, unemployed, and I have no idea as to where she is living or how to get a hold of her. Her mother also has had no contact with her and has been trying to assist me as much as possible. What are my options for getting legal custody of my son and having the state stop my child support payments, since I have my son 7 days a week and am paying a babysitter out of pocket after school? I have been to the Department of Childcare Services, the Department of Revenue, and nobody has any answers for me.

You have a very good chance of obtaining custody.

A petition to establish your parental rights has to be filed with the Court.

In all fairness to the Dept. of Revenue, they are swamped with requests for assistance.

If you were married to this woman when your child was born, then there is no issue of paternity. file a Petition for Custody, Child support and supervised visitaition.
