Legal Question in Family Law in Florida
A few years ago we were divorced and have one kid. At the time it was the best interest to put our child in her father's custody due to an auto accident. We have lived together since right after our divorce. Now, how would the custody thing work here if they go their separate ways who can get or take the child? The father works over the road a few days a week while the mother is disabled.

The child is still both your ex and yours. If you want to seek timesharing, formerly custody, then you can file a petition for modification of timesharing. If they divorce, your child is still yours and your ex, if you're hinting that his new wife would keep her, she has no connection at this time.
