Legal Question in Medical Leave in Florida
Can my employer fire me and threaten me wile onfmla
I am a pharmacist, working for CVS in Florida, I worked more than 100 hours
per week days and night because of a shortage of pharmacist. I've covered
half the State.
My behavior started changing I started arguing with customers using foul
lanuage after 4 month my supervisor and districrt manager came in to
terminated me when I told them I needed help, Ineeded anger management,
I'm doing thing I can't explain, My diabeties in out of control, and I recently
fell out at work from a gall bladder atttack and the doctor said I need
surgery, they then decideded to suspend me.
I requested help and they said CVS had no such program, Icalled CVS main
office and I applied for FMLA and short term disablity. I found out they had
mental counseling and I took advantage of it.
Now my immediate surpervisor calls me the next day saying they intended to
terminate me, I told him I was on medical leave and and have sought out
treatment and I going to talk with a lawyer.
Can they stop my FMLA and disability and terminate before I get
treatment???? And did I get FMLA in time

You could possibly have a FMLA cause of action and possibly a "perceived as disabled discrimination claim.
