Legal Question in Medical Leave in Florida

Employer violation of FMLA

A co-worker of mine works for a large hospital organization in Clearwater FL, she was approved for leave for a surgery. now that she is ready to return to her job her employer is stating that she can not return, her postion isn't availble, that b/c she would be on light duty there isn't a comparable postion for her, yet her employer is blocking her from transfering to another postion entirely. What recourse does she have?

Check the Department of Labor web site. This does not sound like an FMLA violation. Consult with human resources.
