Legal Question in Medical Leave in Florida
Family Medical Leave Act
My company agreed to allow me the 12 weeks of Maternity leave that was allowed by the company. i decided on my own to return at an earlier date. When i returned to work on the day that i was scheduled they informed me that i was not on the schedule and that they had no hours for me to work. Since then i have called and been told that they don't know what is going on and that people are quitting because they have no hours. I visited my place of employment and found that they had hired 3 new people. If they have hours to hire new people why are they not putting me on the schedule. I need to know if it has to do with paperwork that was not filed properly or discrimination. They have not terminated me but they won't let me work. Also the manager was supposed to fill out a reference form for me so that i could get a job with the school system and she never did it, thereby sabotaging my ability to gain work elsewhere. Do i have a case?

You need to see an employment law attorney for a consult asap to see if you have an FMLA claim and/or a pregnancy discrimination claim. In the meantime, make sure you put in writing that you want to return to work (email if possible).
