Legal Question in Medical Leave in Florida
Fired For absense from work after filing FMLA
I was fired from my job after filing for FMLA. Is the FMLA retroactive? I have been told it is. My prior place of employment is currently under investigation by OSHA, for paint fumes as well as mold. I have epilepsy, a pre-existing condition and migraines, that started 6 months after I started working there. Do I have a case?

Re: Fired For absense from work after filing FMLA
You may, but I would need more information first about the leave you requested (timing, type, etc.)and the size of your employer (more than 50 employees?). Please feel free to call for a complimentary consultation.
Good luck.
