Legal Question in Medical Leave in Florida
FMLA cover birth
My employer informed me I am not qualified under FMLA or any other law to take a maternity leave once I give birth to my daughter. Is it true that not every employer has to comply with FMLA?

Re: FMLA cover birth
both the employer and employee must qualify to be held to and benefit from fmla. the employer must employ at least 50 employees or be a part of a larger company that employs at least 50 employees. the worker must have worked for the employer for at least one year, or at least 1250 hours. if these things are not met, then fmla does not apply.

You might try looking on the U.S. Dept. of Labor website for all the specifics of the act. It is fairly user friendly. Good luck!
