fmla termation

my son was working with this company for 5mths he got sick and ask for fmla they terminate him and told him he could rapply if the position is advailable. he did reapplywhile the position was advailable but they called him and told him they hire someone else is that possible

Re: fmla termation

FMLA only applies to employees who have worked for the employer one year or more. They had no obligation to hire him back.
