Legal Question in Medical Leave in Florida

I live in the state of Florida and just had a baby 5 weeks ago, I had originally told me employer that I would take six weeks maternity leave, but now I changed my mind and want to take 12 weeks. Can I loose my job based on my decision?

P.S. My job does not pay for maternity leave.

How many employees does your employer have. If they have at least 50 employees they are subject to the Family Medical Leave At and most likely need to give you the full twelve weeks leave time, they do not need to pay you for your time, but must hold your position open for you while you are out. You probably want to look at any employment manual that sets out their FMLA policies or speak to your HR director. Feel free to call my office if you have any questions regarding this matter.
