Legal Question in Medical Leave in Florida

Maternity Leave

I am 36 weeks pregnant, I have been working at this same job for about 8 years, they have told me we don't have a ''maternity leave'' plan, which in other words they are telling me they don't have to pay me the time that I am out, is that right? Are they obligated to pay me?, or just have my job for when I come back?

It depends upon the size of the company. If you have sick or comp time you generally could use it while on leave. IF you are medically unable to work, you have have a disability claim. If you have an employer with over 50 employees, you may be able to take FMLA which allows you 12 weeks of UNPAID LEAVE, and they must keep your position open.
