Does one have to be a permanant employee to apply for FLMA

You do not have to be a "permanent" employee, whatever that means. (There are no permanent employees.) But you have to have worked for the company for at least 12 months (not necessarily consecutively), have at least 1250 hours of work in the year preceding the first day of leave, and the company must have at least 50 employees in a 75 mile radius.
