Required to take FMLA

If I am going to be out of work for about two to three weeks, and I am going to use my annual leave benefits to cover my time, do I have to claim this as part of my FMLA entitlement? I thought FMLA was meant to protect individuals when they did not have leave available to them so they could not be terminated for excessive leave.

Your employer can consider time off for sick leave to be part of your FMLA protected leave. FMLA grants you 12 weeks of protected leave and not all your sick leave, vacation leave plus 12 weeks of protected leave. But do check with your employer to confirm how they handle these issues.
