Re: What are my rights under FMLA?

If you are cleared to return to work, and can return to work full time, they need to put you back in your old position, or a substantially comparable one (in benefits and salary). THis is assuming that your company must abide by FMLA (has at least 50 employees) and you have worked enough hours with them to get FMLA.
