Legal Question in Medical Leave in Florida

Working while on leave in another city

I live 170 miles from work. I had to take FMLA because my spouse became seriously ill (hospice). Can I work at a job locally to generate some income or am I not allowed to work at all? I would work some if my job were closer. I have been granted FMLA but will it be jeopardized if I work?

Re: Working while on leave in another city

I'm sorry to hear of your problem. Unfortunately, technically, you would not be entitled to FMLA for the time you are working because you would not be caring for your wife at that time. So the employer could hold that time against you. It would be heartless to do so under these conditions, though. I recommend talking to HR or a trusted supervisor to see if something could be worked out. Let them know you must be with your wife as much as possible, but must also work locally for financial reasons. If they refuse to allow you to do so without agreeing not to take action against you, then you can decide how to proceed. If they do agree, get it in writing - at least an email.

Good luck.
