Legal Question in Civil Litigation in Florida

Abandoned auto

I have a 74 years old friend going through this problem now. she wrote me the following email and I am writing to you for assistance. ''I have been trying to solve this situation but am not reaching a calm solution. After the death of my husband I sold his car to my son's stepdaughter.I asked that she returned the car to my home if ever she was going to get rid of it since it had sentimental value to me. That member returned the car with out the title and abandoned it for 1.5 years on our property. We asked for the title multiple times and she states she does not have it. A duplicate form was sent to her and she wants me to pay for it. Now she threatens us with the police telling them it is stolen. What can I do? It has sentimental value to us but at the same token this has gotten out of hand. My son reached her for the title and she said she would notify the police.

Re: Abandoned auto

If the car was sold, then your friend no longer has a right to it. If it was so important to her, there should have been a buy back provision or something in writing. I assume there was not.

The abandoning at her property is a little strange, as is the threat to call the police. The car is the stepdaughter's. I wouyld suggest that they write the stepdaughter and confirm that the car has been on their property for over a year because that is where she left it. If she wants it, please come pick it up.

They might want to just offer to buy it for a small amount that will intice the stepdaughter to sell it back and sign the title.

good luck.
