Legal Question in Civil Litigation in Florida
Accident Compensation
My friend lost a hand in an accident abroad while working for a major defense contractor. He was held in the country by the contractor until they were ready to let him leave. He received poor medical care, and feels it was not the ''western medical care'' that was promised in our contract. When he was allowed to leave and did return home he was told it was too late to be fitted for a prosthetic since there were time limitations involved. We feel the contractor grossly mishandled his accident and possibly violated the rights of him and others in their private investigating of the accident. (They did not contact the local authorities.) How can my friend find if there is any merit for a civil suit against the contractor and if so, where should it be filed?

Re: Accident Compensation
You can indeed bring an action against the corporation depending on what the contract says. You may contact me at [email protected] or see my website at floridatrial.com for more information. Charles Morehead
Re: Accident Compensation
Your friend may be able to file an action against the company depending on the language of the contract, the facts and circumstances surrounding the accident, subsequent remedial measures, if any, taken by the company and actions or inactions taken by other third parties. I would have to read the contract, learn certain facts like the identity of the company, where the accident took place, where the injured party resides, how the accident occurred, whether there may be other parties at fault for the accident, and other matters that would only be flushed out with an in depth consultation. Issues such as worker's compensation immunity, jurisdiction, and liability of third parties are important at the outset. Feel free to contact me at [email protected] or 305-445-0937. Seek the advice of counsel and good luck.
