Who is at fault when you car gets hit by someone backing out in a parking lot when the person hit was speeding?

Both. A judge or a jury are allowed to decide the percentages of fault based on the facts. They can decide, for instance, that the speeder was 60% at fault and the person backing out was 40% at fault. Then the damages are awarded based on the percentages they come up with.
