Legal Question in Civil Litigation in Florida

Accident/ Subrogation Claim Notice

We have been served with a notice of subrogaion claim from an accident that happened two years ago in NV. We knew nothing of the claim until now. The Law group representing the other party will not give us any documentation to support their claim. Are they legitamate? What rights do we have? What type of legal assistance should we seek?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Obviously, nobody can tell you whether or not this claim is legitimate without more information including, at the least, the name of the firm. Insurance companies often do subrograte any claims they pay by seeking payment from the party who caused the accident.

You have the right to know what the claim is about and what damages were incurred. You have the right to defend any action if you feel it is improper. You also have the right to try and negotiate a settlement if you do believe you were at fault and should pay. You should seek the assistance of an attorney to represent you.
