Whether or not the dog has attacked anyone in the past and if you were following all local ordinances such as leash laws, whether your dog is a legal breed (for example in Miami Beach, pit bulls are illegal and any owner would have automatic liability for any action by this breed regardless of past history)will all be important. You will want any people that can testify to your dog's nature and any training he may or may not have had. Please check what are called "dog bite" statutes. If you are defending yourself, visit the local county courthouse library and ask the librarians to guide you in where to research cases and statutes.

You probably mean that you are defending yourself since any claim will be made against the dog's owner, not the dog. You should consult an attorney regarding the specific facts of your case.
