Legal Question in Civil Litigation in Florida
Auto Damage
My truck was parked out front for sale, I had no insurance on it. It was not registered. A neibor turned around his 18 wheeler next to it and hit it, he took off and did not inform me. The poioce chaged him with improper back, really it was hit and run. He gave wrong info to the police as far as insurance co. The owner of the truck said he would setle out of courtnot to call the insurance co., did not, when i called to remind him of the incident he said Talk to my lawyer and hung up. My question is , who do I file small claims on the driver or the owner or both?

Sue both. If the neighbor is giving you a hard time, do it now and don't wait. He needs to learn a lesson and pay for his mistakes.

Re: Auto Damage
you may sue both.
You will find, however, if you do not know already, that you are in violation of Florida law for not having insurance on your vehicle and for not having it properly registered and titled.
