Legal Question in Civil Litigation in Florida

bad home inspection

I hired a home inspector to check the home I just purchased. He hired the air conditioning inspector. The air man told me it was old but it just needed needed routine maintenance. He put this in writing on his report. It also said he was not responsible for anything. When I moved in two weeks later the air was not working. I had a service guy look at it. He put in three pounds of freon and it leaked out by the next day. I had to get a new unit for twenty two hundred dollars. I called the airconditioning place owner. I spoke with him ten times, he blew me off most of the time. He then agreed the guy should have known about the leak. But he also said tough luck. Can I take hime to small claims court? I know I could have talked the owner down at least a thousand if I knew the air was broke. The house was sold as is, so I don't blaim the owner. But I hired the inspector for this reason. Thanks

Re: bad home inspection

You make a good argument. The case would depend on

all the facts and circumstances presented to the

judge. Be careful about language contained in any

agreement you had with the air conditioning company.

The case could go either way. No one can tell

you for sure how a judge would rule.
