Legal Question in Civil Litigation in Florida

Bad roofing job

Re-roofing job was done last June. The contract states that ''rafter helpers'' will be installed as needed. I'm getting ready to replace some soffit and found a rotted rafter end which should have been addressed during the roof job.

Roofing company says that they will charge for any work done at this point since, they claim, that all the allowance for wood was used during the job. This, even though they brought neither the rotted rafter nor the wood allowance to my attention at the time. Fascia in the same area was replaced which clearly exposed the rotten rafter at that time.

Should I make repairs first to all rafters that require it documenting everything, or await the outcome of complaints and/or legal action to see if the company is ordered to make the repairs itself.

With hurricane season approaching, I'm assuming that the prudent way to go would be to get the work done now with detailed documentation.

Thanks for any help offered.

Yes you should probably get the work done now and then document the rot and get names and addresses and ideally signed affidavits from the new workers as evidence. Courts don't normally like to force performance of services because they won't be done well; so you'll be asking for the costs to be reimbursed...probably in small claims court.
