Legal Question in Civil Litigation in Florida

Help on Getting Belongings Back

Hello, My girlfreind and I recently broke up and she has things of mine that I want back specifically a guitar that was given to me by her parents. I have the receipt for the guitar but it has her mothers name on the receipt. Could I take action in getting my guitar back or am I out of luck? Thank you in advance!

Im not sure what sort of law this would fit under so I apologize if I selected the wrong area.

You can always file a lawsuit in small claims court for the return of the guitar. You would have to pay the filing fees to the court and then seek reimbursement if you are successful.

It would be your responsibility to prove that the guitar is yours and not the mother's. You can use any form of evidence that you might have including witnesses who might be able to testify as to ownership. Good luck.

Re: Help on Getting Belongings Back

This would be very messy and you would probably lose in small claims court; you don't know that her mother would want you to keep the guitar gift.
