Legal Question in Civil Litigation in Florida

I boat a boat from a private party and he (for whatever reasons) will not deliver the title. I know that he is the legal owner of the boat and that there are no liens against it. Can I file in small claims court for delivery of the title and if so what is the action called? Thanks

Yes you can, but small claims only goes up to $5000 in Florida. Want to know the law without going to law school? Protect yourself against ripoffs? Sign up for a free legal newsletter on various areas of consumer law by going to www.ConsumerLawyerHelp.com.

You can enforce a contract in small claims court. But, you didn't say whether you paid the full purchase price (or what it is) and why the owner did not transfer title. A judge will decide based upon all the facts (NOT just your story).

File a claim to enforce the sales contract by suing for delivery of the title.

Yes, you can. Many local courts have small claims forms available online. You want to sue him for breach of contract. Retain any proof of purchase or payment as evidence in your case as well.
