Bought watercraft, seller didn't pay off loan, lien on item

A few years ago we bought a boat from an individual. At the time he advised us he owned the boat,and the title was clear. We made the cert. check payable to him. He was to mail us the title, but he never did. When registering the boat we found there was a lien against this boat from the bank loan. We pursued this matter with the seller via telephone and email. We were told a sob story that his business partner ran off with all his money. He begged us not to take any legal action at that time, as his father was in another state and dying of cancer. One excuse after another. Years later, we still have no title. At this point we want to sell the boat but are unable to do so as we have no title. Is there anyway to force the seller, if we can loacte him, to pay off the loan and give us the title?

The moral of the story is to check this FIRST. You are pretty much stuck and likely won't be able to recover at this late date.
