Legal Question in Civil Litigation in Florida

Breach of home loan contract

Hi,

I have a home loan on a house that I tried to sell for a profit b4 the market crashed. Received papers from their lawyers that they will file a lawsuit to get their money back. Is there any other way besides being a head of household to protect my wages from being garnished? And what is the usual outcome of those cases? Should I be frightened that they will file a case? Is it better to file for bankruptcy since my credit is already ruined. The loan was for about 40K. I already had a home credit line in trying to keep house but could not. Thanks.

Re: Breach of home loan contract

I do not practice in real property law, foreclosure, banking, wage garnishment, or bankruptcy.

There are many FL attorneys on this site who do practice in those areas. If one does not answer this question, I suggest you resubmit under real property law catagory.
