Breach of promise, annulment

I am 80 years of age and married a guy two years ago in Wisconsin. I have a home in Illinois and my new husband basically lives in Florida during the winter months. We spent the first half of our marriage in Florida and after that episode, I decided I wanted to move back to Illinois because he did not pay any attention to me and is impotent. He did not share this info with me earlier and waited later to tell me. He does not help with paying bills and is just excess baggage. I vowed not to return to Florida with him and he has been there all year and does not call or write. What steps should I take to get a divorce or an annulment? Is this considered a breach of promise? If so, what is my next step. He is still in Florida. thanks!

First, I'm sorry to hear that your husband ignored you and is impotent. Perhaps dedicating a little more attention to you and experimenting with Viagra could have salvaged the marriage. Second, since you recently married in the State of Wisconsin, you should seek the advice of a family law attorney well versed in Wisconsin law.

I am not a family law attorney, but my understanding is that if your husband is agreeable to a divorce, it is a relatively painless and inexpensive process so long as both parties cooperate and there are no thorny issues concerning alimony, property distribution and child custody. It's unlikely that you and your husband have had children, and odds are you have not acquired much in terms of marital assets over the last two years, so the divorce should not be a major undertaking.
