Breaking Contract with Wedding planner

My Fiance and I signed a contract with a wedding planner in 2/14/09 and she hasn't been planning anything. She got sick and was in the hospital for 2 weeks. It was very Unfortunate but I don't feel she has been professional or in top of things. She hasn't done any planning. I've been in top of her and all I have received is an email from her and a few text messages.

My fiance and I went to her office very professional and told her how we felt. She then tried lying about how she's sent us like 10 emails(never did). At this point we really realized who we were dealing with and told her we have only received one email from you since 2/14/09. We gave her a letter typed by my fiance termanating the contract. There was a part in that letter that she didn't agree on so we said if we take that part off will you sign? She then said yes. We left her office came back an hour later with the letter corrected for her to sign and she was not very nice and told us she had no time for that to fax it to her and then she would show it to her attorney. I told her no, we are here already so here is the copy. She took it and that was it. I have a copy of the contract. Can I terminate contract it was signed a month and 1/2 ago...?

If she has breached the contract, then you can terminate it. Look carefully at the contract itself, however. There may be specific provisions regarding termination that could affect you ability to terminate the contract as you have.

Whether her action, or inaction as the case may be, constitutes a breach of the contract will likely depend on the language in the contract itself. If indeed the planner did commit a material breach, you can consider the contact void and get another planner. Additionally, you may be entitled to damages as a result of the breach.
