Does my brother have a case against me?
A friends brother received a settlement of approximately $60,000 from an accident case several months ago. Upon receiving the sum they opened a money market account in my friends name payable to his brother upon death and his brother willingly deposited the monies into the account. Since this time,the brother is now back with his estranged wife, retained an attorney who put a freeze on the money market account and has tried to get my friend to sign power of attorney to him so he can get his money. He has tried to settle with him on several occassions to return the monies to his name, but to no avail. No law suit has been filed in 3 months. During the time when the brother tried to gain power of atrorney, he had my friend marchment acted at his place of employment, he stole his car by changing the name on the title while my friend was in the facility for 3 days(he filed a police report). Through these consequences he lost his job, car, income, apartment and way of life. He now lives with his parents until this case can be settled. He wants to settle this dispute but feels as though he should be compensated for the above. Does the brother have a legitimate case and who is responsible for paying taxes on the monies if it is frozen?
