Legal Question in Civil Litigation in Florida

I have a car loan from a buy here pay here at 25 % interest.I had the vehicle for little over a year.Made every payment on time. But with the sagging economy, just could not afford it.So, i gave it back.About three weeks after that a person calls me asking questions about the vehicle.I asked who she was was.She told me she represented a man who bought my car loan.First time I ever heard of any of this.Well 6 months after the fact, he is suing me for the difference of what I owed on the loan and what he sold the van for.$2,500.My question is can he do this ?My contract is not with him. I never made one single payment to him. I did not drop the vehicle off with him.I do not know who this man is.I am an unemployed single mom with no money for this. Can you please help me me??

The man can sue you if he bought the loan on your car from the original holder. The assignment of the debt should have been part of the exhibits to the complaint served on you. If it was not, you should move to dismiss his complaint. Since you are in small claims court, the clerk's office may be able to help you with this type of pleading. Otherwise, you may need an attorney.

Good Luck.

No, we cannot help you. Whomever holds the title owns your car. Sorry.
