Car Repair NightMare

I purchased a car in miami fl. and upon delevery of the car the dealer put a battery in the car,that turned out to be to large.Because of this it arked on the hood and now has costs me thousands of dollars to fix.What can I do to force the dealer to refund me the costs and also fix the car correctly?I have statements from the mechanics that the problems were due directly because the wrong battery was installed in the car.What is the money limit in florida small claims court?

Yes, you can file claim in small claims court.

The jurisdictional limit on the amount the court

can award is $5,000 plus court costs.

Just a suggestion regarding a tip that has worked well for us in

similar cases. Also, it might save you the court filing fees and

possible costs of litigation.

Draft a letter to the General Manager of the dealership setting forth

the chronology of events surrounding your purchase, and include a

copy of the mechanic's statement indicating the cause of your repairs.

Lastly, briefly highlight the legal arguments that support your position,

and explain that you would prefer to resolve this dispute outside of

court if possible.

A high percentage of the time, we have been successful in avoiding expensive

litigation for our clients. Of course, if this technique doesn't

work, there may be no alternative than to file a Complaint.
