Legal Question in Civil Litigation in Florida
If I caused a car accident 10 days ago, was 100% at fault, and the medical/civil liability against me is potentially much more than the limits of my auto policy, do I have the right to start distributing gifts to my children from my estate, in the amount of $11,000 each, right now, BEFORE I am even served notice that I am being sued by the victim? Also, will my children potentially have to give the money back IF the suit goes forward for more than the value remaining in my estate?
My purpose is to NOT leave my children without at least a small legacy if this suit wipes out my estate.
