Legal Question in Civil Litigation in Florida

child damaged neighbors car

Neighbor says that a month ago my son scrathed his car with his bike. he went out of town before he contacted me. he said another child also did a small scrath also, but because he says my son did biggest mark we are to pay for it. I was notified a month after it happened, and now 6 months have passed and now he wants payment. my son did admit to the damage, but already a month had passed before

i was able to ask my 8 year old son. does the length of time before the neighbor contacted me affect this? am I obligated to pay for this since he let a whole month pass before contacting me and in that time he admitted he went out of town. My son is 8 years old and I belive he would have said he did it to avoid getting in trouble. ALSO,there were other neighbor children were riding my sons bike. Would his comprehensive coverage on his auto insurance cover this type of damage?

Re: child damaged neighbors car

Pay for the damage that your son admitted to. Even if your neighbor has insurance, I doubt his deductible would cover it, and furthermore, your som admittedly did the damage, so your neighbor does not have to claim it through his own insurance carrier. The fact that a month went by before your neighbor asked for the money is irrelevant. Good luck,
