what do i do to take legal action to someone who stole 400 dollars from me

You can report the theft to the police, and if the state's attorney decides to prosecute, there will be a criminal action started. You can also take the thief to small claims court. Your county clerk will probably have forms for you, will will not be able to tell you how to fill them out.
