Collecting on a Judgement in FL
I was awarded a judgement of $3000 in March. A Form 1.977 was sent to the defendant at that time, and the 45 days to complete and return it have now passed. It has not yet been returned. I have the defendants bank account information and would like to go ahead and do a garnishment on it. What would be the steps to do this? Also, I live in Tampa and the judgement was entered in Miami (where the defendant lives)... where would I file the garnishment? Thank you in advance for your assistance.

A writ of garnishment is sent to the bank that has the money. It is filed in the case and served upon the bank.

Is the Defendant collectable? Does he have assets to collect upon. I could probably help you with collecting upon the judgment and under FLorida Statutes they would be required to pay my fees. Feel free to call or e-mail me to discuss further.
