Computer Was Gift / Employer Wants It Back

My employer purchased a computer for me in July 2005 as a college graduation gift. I recently left the company and he wants it back. However, I have several emails that demonstrate it was a gift (''Enjoy it in good health and happy graduation!'', ''You deserve it!'', etc.).

Can I legally keep the computer? Are emails considered evidence in small claims court (if it should come to that)?

I think you can make a case the PC was a gift. The e-mials are not admissible by themselves - you would want him to testify he wrote the e-mails, and that he wrote the content of the e-mails (see the difference?).

Is it worth the laptop? If yes, keep it and let him sue you for it. If not, return it to him in pristine condition.
