Legal Question in Civil Litigation in Florida

Condo Rental Time Periods

The binder given at closing has a Declaration of Condominium which states that the min. rental period for a unit is 1 month, however in the Rules and Regulations for Condominium this is shown as 3 months.

Does the RR's supercede the DOC? Which is correct?

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

The chances are that the Declaration of Condominium given to you at closing may not be current with all amendments. I would venture to guess that the Rules and Regulations are probably more up to date and would suggest that you abide by them. You can always verify the information at the association's office to see which is correct.

You should get instructions in writing from the Assoc. regarding which requirements are current, if either is.
